FFL DEFENSE IS OVER

100311:
TodayTechPlate received notification that we continue our qualification as a California Exempt Federal Firearms Licensee (CEFFL) pursuant to Penal Code section 12071.  As of today we can receive firearms at TechPlate.
091411:

TechPlate has received its FFL and you can find it here: FFL 2014
Now TechPlate is applying for the various California DOJ permits which are mandatory.  My experience is that this is an efficient process and that we'll be fully operational within a couple of weeks.  In today's world of information overload this may mean in the blink of an eye.  I will continue to keep you posted.  Thank you for your continued patronage.

080311:
On Friday July 29 TechPlate was inspected by ATF for readiness to receive its FFL.  It was concluded that due to a DOJ order, a Dealer's license, i.e., an 01 was best suited for the purpose and add $50.00 for the privilege.  TechPlate was an 07 prior.  If all is good with the powers that be it is said that it is just a matter of a few weeks now.  We do have a list going and we will post a notice here.  Of course we look forward to being of service again.

092810:
On this date the ATF DIO Earl Kleckley signed off on the settlement agreement.  The effective date of the agreement is October 7, 2010.  On October 1, 2010 TechPlate's FFL expired.  We are able to continue processing firearms (frames & receivers) until October 7. The salient points of the agreement are as follows:
  1. TechPlate will not process firearms (frames and receivers) requiring an FFL Manufacturer's license, until a new FFL is granted by ATF.  All other firearms' parts are fair game, e.g., slides, barrels, small parts, etc.
  2. TechPlate shall return, within 24-hours, to sender all firearms received unsolicited.
  3. TechPlate shall apply for a new license after 60 days, without prejudice and ATF will process the new license application within 60 days..
092410:
It has been reported to me by Jason Davis, attorney representing TechPlate in the negotiations for a Settlement Agreement, that TechPlate will continue to receive and ship firearms until October 6, 2010.  This, at this time, is based on the presumption that ATF will sign the latest agreement revision.

TechPlate will be allowed to return any unsolicited firearm received after the October 6 deadline.


092310:
Please be aware that our FFL expires on October 1, 2010.  We will not be applying for a new license until December 7, 2010 as a condition of our settlement agreement with ATF; and if all goes as planned we will have a new license soon after January 7, 2011.  So, although our revocation is not effective until October 7, we will not have a license after October 1.

TechPlate receives $100 from Mr. & Mrs. Ken Karsted.  Ken, if you're reading this please know that we really appreciate you good will gesture.  Please keep in mind that you have a $100 credit on file with us.

It is reported to me by Jason that Paul Ware, attorney for the government (ATF) has approved the language of the agreement and that now it only needs Earl Kleckley's signature.  Earl is the Director of Industrial Operations ("DIO").  He represents the DOJ in this agreement.

TechPlate accepts the No Appeal clause and tweeks the agreement a bit with less substantive details. and re-submits to ATF.

ATF counters with Settlement Agrement with the following provision added:  "TechPlate will not file an appeal", i.e., an appeal for judicial review of the ATF final decision to revoke.  

091010:  
TechPlate submits version 1 of the settlement offer.  The salient point being, that, TechPlate will give up its FFL voluntarily and without prejudice for 3-months., at which time TechPlate reserves the right to re-apply for a new license and the previous violations will not be held agains TechPlate in the decision making process by ATF.

090710:
 It is agreed between TechPlate and attorney Jason Davis that TechPlate will propose to ATF a settlement agreement.  Terms to be determined.  It is Jason's advise that we try to settle this matter without goint to court.  My brother is an attorney in Oregon and he is of the same opinion, i.e., "the worst settlement is better than the best trial", sort of speak.

We have just received word from our attorney, unofficially, that we have been given a 30-Day stay on the effective date of revocation.  This will  translate to October 7, 2010

Thanks for visiting TechPlate's ATF Defense page.  I hope you've had a chance to read our letter to our customers and gun enthusiasts.
This page is dedicated to getting the word out for raising money to help defer the cost of TechPlate's defense in its continuing battle to maintain its FFL license.  It is of paramount importance if TechPlate is going to continue to offer plating and finishing services to the firearms industry. Without this license we will no longer be able to receive firearms, that is, anything that includes a frame or receiver.  All the other parts we can accept.  The deadline we're up agains is September 5 of this year.

This battle has been in progress since receiving our Notice of Revocation on January 2010.  Since then we have amassed a plethora of evidence to controvert ATF's allegations. The arena for this battle is the federal distric court, were the billing will read: TechPlate v. The Department of Justice.  My estimate at this time is 50-hours of legal work @ $250 per hour.  That equals $12,500.00.  This should get us through what is referred to as summary judgment.  This is where the judge summarily decides if this case will go on to be heard at trial.
